CITY COUNCIL MEETING

April 21, 2008

5:15 P.M.

 

he city council met in special session with the following present: Mayor Jack E. Rowden; Councilmen Gary Baughman, Mike Eshbaugh, Greg Gill, Kim Harper, and Bob Mason.

Others present were Outside Utilities Supervisor Dean Banker, City Clerk Thomas G. Hicks, City Attorney Wayne R. Tate, and Gary Baker.

The purposes of the special meeting were to discuss the possible acquisition of real estate and to discuss a personnel matter.

Mayor Jack E. Rowden presided.

Motion by Councilman Kim Harper, seconded by Councilman Bob Mason, that the meeting go into executive session in regard to the possible acquisition of real estate. Motion carried. Mayor Rowden called the meeting into executive session at 5:15 p.m. with the meeting to reconvene in open session at 5:45 p.m.

The meeting reconvened in open session at 5:48 p.m.

Motion by Councilman Mason, seconded by Councilman Eshbaugh, that the meeting go into executive session in regard to the possible acquisition of real estate. Motion carried. Rowden called the meeting into executive session at 5:51 p.m. with the meeting to reconvene in open session at 6:06 p.m.

The meeting reconvened in open session at 6:00 p.m.

Motion by Eshbaugh, seconded by Gill, that the meeting go into executive session in regard to personnel matters. Motion carried. Rowden called the meeting into executive session at 6:16 p.m. with the meeting to reconvene in open session at 6:36 p.m.

The meeting reconvened in open session at 6:32 p.m.

Motion by Gary Baughman, seconded by Mike Eshbaugh, that the meeting be adjourned to May 5, 2008 at 5:15 p.m. Motion carried.

 

CITY COUNCIL MEETING

April 7, 2008

5:15 P.M.

 

The city council met in adjourned session from the meeting of March 10, 2008 with the following present: Mayor Jack E. Rowden; Councilmen Gary Baughman, Mike Eshbaugh, Greg Gill, Kim Harper, and Bob Mason.

Others present were Outside Utilities Supervisor Dean Banker, Chief of Police Steve Lewis, City Inspector Tony Martin, Electric System Supervisor Gary Rowden, City Attorney Wayne R. Tate, Carrie Baeza, Richard Barnes, Charles Wagner, and Ruthie Winget.

Mayor Jack E. Rowden presided.

The minutes of the meeting of March 10, 2008 were approved as mailed.

Each member of the governing body was provided a copy of Municipal Judge Sherri Leonard’s report for the month of March, showing 12 new cases brought before the court and $2,487.55 remitted to the city.

CHARGE OFFS

Motion by Councilman Kim Harper, seconded by Councilman Mike Eshbaugh, that uncollectible utility accounts in the amount of $4,980.75 be charged off with every effort made to collect the accounts. Motion carried.

Councilman Gary Baughman arrived at 5:33 p.m.

CITY INSPECTOR

City Inspector Tony Martin presented a monthly activities report.

GAS WELL #2

Charlie Wagner presented a report of the work over of the Fee #2 gas well. There is a good increase in volumes estimated from 70,000 to 100,000 mcf. This is approximately an increase of $180,000-200,000 per year. There is a capacity problem due to the 3" pipeline. Mr. Wagner recommended two solutions.

Install compression.

Lay a 6" line from north of the Westfield Apartments connection to Fee #2.

Mr. Wagner feels eventually the City will need to go with solution #2. He is recommending waiting 3-6 months before action is taken for a longer term test on the new work over.

POWER PLANT

A proposal of $52,428.00 by Moore’s Roofing Co. was presented to re-roof power plant #2. Richard Barnes is to check with Brad Musgrove to see if the insurance will cover any part of the roof replacement. He is also to look for other estimates. Moore’s proposal is good for 60 days from 3/20/08.

ELECTRIC RATES

Motion by Councilman Kim Harper, seconded by Councilman Greg Gill that Ordinance No. 752, AN ORDINANCE ESTABLISHING ELECTRICAL SERVICE CLASSIFICATIONS AND RATES AND CONDITIONS FOR SERVICE WITHIN THE CITY OF HUGOTON, KANSAS, AMENDING ARTICLE 1, ELECTRIC SERVICE, SECTIONS 17-110 THRU 17-121 OF ORDINANCE NO. 572 OF THE CODE OF THE CITY OF HUGOTON, KANSAS, 1991, REPEALING ORDINANCE NO. 747 AND REPEALING ALL OTHER ORDINANCES IN CONFLICT HEREWITH, be passed. Vote: Baughman, yes; Eshbaugh, yes; Gill, yes; Harper, yes; Mason, yes. Motion carried.

NATURAL GAS SUPPLY

Motion by Councilman Kim Harper, seconded by Councilman Mike Eshbaugh to authorize the mayor to execute the assignment of the large volume purchase contract with Aquila, Inc. to Black Hills Utility Holdings, Inc subject to the city attorney investigating the benefits of filing a protest with the KCC. Motion carried.

WATER

Motion by Kim Harper, seconded by Greg Gill to approve the 2008 Water Conservation Plan. Motion Carried.

WATER

Motion by Kim Harper, seconded by Mike Eshbaugh to approve the 2008 Water Emergency Plan. Motion Carried.

MEETINGS

The annual Kansas Municipalities Conference will be held May 14-16 in Wichita. Motion by Councilman Bob Mason, seconded by Councilman Gary Baughman to approve two city employees to attend if there is interest. Motion Carried.

Claims against the city were presented and audited. Motion by Councilman Gary Baughman, seconded by Councilman Greg Gill, that Appropriation Ordinances No. 1859 and 1860 be passed. Motion carried.

BIDS

Bids were opened for the replacement of valley gutter and curb at the following locations.

Motion by Councilman Kim Harper, seconded by Councilman Bob Mason to accept the bids of McBride Construction for $2,100.00 and $6,655.00 to repair 9th & Main (West) and 2nd & Jackson (East), respectively, and the bid of G&M Construction for $10,586.00 to repair 5th & Harrison (East & West). Motion carried.

COMMUNITY SERVICE

The outside utilities supervisor announced clean-up week would be from May 27 - 30.

PARKS

Electric System Supervisor Gary Rowden informed the council he would like to plant more trees in Raydene Park, City Park, and the North Reservoir. He is to check on prices.

TRAFFIC

City Attorney Wayne R. Tate is to draft a letter to United Prairie Ag informing them that the City does not need to wait a year to see if the signal and barricade system will work. They are not adequate and need to be addressed now.

POLICE, BIDS

The renovation of the police station is almost done. Chief of Police Steve Lewis presented three bids on flooring.

Flooring America $3,985.00

Finishing Touches $4,499.64 (does not include moving furniture)

Allen Browns Furniture $3,764.58 (less $208.00 no padding)

Motion by Councilman Gary Baughman, seconded by Councilman Bob Mason to accept the bid of Allen Brown’s Furniture. Motion Carried.

Motion by Councilman Kim Harper, seconded by Councilman Gary Baughman that the meeting go into executive session in regard to personnel matters. Motion carried. Mayor Jack E. Rowden called the meeting into executive session at 7:03 p.m. with the meeting to reconvene in open session at 7:18 p.m.

The meeting reconvened in open session at 7:15 p.m.

PERSONNEL

Motion by Councilman Kim Harper, seconded by Councilman Bob Mason, to hire Kenny Burrows in the Street Department at a rate of $13.76 per hour. Motion carried.

GOLF COURSE BOARD

Tony Hall and John Akers term on the golf course board is up this month. City Clerk Tom Hicks is to advertise for anyone interested in being on the board to submit a letter of application.

BOARD OF ZONING APPEALS

Mayor Rowden announced the appointment of Ray Hoggatt to the board of zoning appeals to complete the unexpired term of Don Trentham. Motion by Councilman Kim Harper, seconded by Councilman Mike Eshbaugh to confirm the appointment. Motion carried. The term will expire in June, 2011.
